APPLICATION by J.B. Ellis & Co. Ltd. On behalf of Seaspan International Ltd., pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence to use the "SEASPAN 270", a Canadian non duty paid barge to be used to move up to 17,000 short tons of solar salt from a deep sea ship anchored in Burrard Inlet, British Columbia, transport it to a storage location for approximately two weeks before bringing it to Nexon Chemicals Canada Ltd. chemical plant in North Vancouver, British Columbia to be discharged, during the period commencing on July 23, 2002 and ending on September 15, 2002.

J.B. Ellis & Co. Ltd. has, on behalf of Seaspan International Ltd. applied to the Minister of National Revenue for a licence to operate the service set out in the title. The matter was referred to the Canadian Transportation Agency on July 9, 2002.

The Canadian Transportation Agency conducted a search of the relevant portion of the marine industry. Notice was given on July 12, 2002 and an offer was received on July 17, 2002 from FMW Towing Ltd. The offer was withdrawn on July 18, 2002.

The Canadian Transport Agency has determined pursuant to subsection 8(1) of the Coasting Trade Act that there is no suitable Canadian ship available to provide the service or perform the activities described in the application.

This determination will be provided to the Minister of National Revenue for any necessary action as provided for in the Coasting Trade Act.

This Decision does not constitute an authority to commence operations in respect of the service for which application has been made.
