Decision No. 405-W-2011
APPLICATION by Tyco Electronics Subsea Communications, pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence.
Application
Tyco Electronics Subsea Communications applied, through its Canadian representative, for a licence to use the “GLOBAL SENTINEL” an American cable layer for the emergency recovery and repair, and any subsequent repair and maintenance as needed, of the NEPTUNE Canada submarine fibre optic cable system, in the western Canadian waters of the Juan de Fuca Strait, west of Vancouver Island, British Columbia, commencing November 1 and ending October 31, 2012.
Issue
Is there a suitable Canadian ship available to perform the activity?
Facts and Determination
Canadian Transportation Agency (Agency) staff gave notice of the application to the Canadian marine industry. On October 28, 2011, an objection was filed with the Agency by ITB Marine Projects LLP (ITB). ITB stated that it had a suitable Canadian ship available to perform the activity described in the application. ITB withdrew its objection on November 7, 2011.
No other Canadian ships were offered. Therefore, the Agency determines that there is no suitable Canadian ship available to perform the activity.
The Agency is providing this determination to the Minister of Public Safety and Emergency Preparedness to consider whether to issue the licence. This Decision is not an authority to operate.
