APPLICATION by PF Collins Customs Broker Ltd., on behalf of OSG Overseas Ship Management (Canada) Inc., pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence to use the "OVERSEAS SHIRLEY", a Canadian non duty paid tanker, to carry crude oil from the Newfoundland Transhipment Ltd. terminal at Whiffen Head, Newfoundland and Labrador, to Portland, Maine, United States of America via pipeline to other eastern Canadian refineries. The tanker may also be used to transport crude oil from Whiffen Head or the Statia terminal at Point Tupper, Nova Scotia, directly to eastern Canadian terminals and refineries capable of receiving crude oil, during the period commencing February 1, 2008 and ending January 31, 2009.

PF Collins Customs Broker Ltd. has, on behalf of OSG Overseas Ship Management (Canada) Inc., applied to the Minister of Public Safety for a licence to operate the service set out in the title. The matter was referred to the Canadian Transportation Agency on January 25, 2008.
The Canadian Transportation Agency conducted a search of the relevant portion of the marine industry and has determined pursuant to subsection 8(1) of the Coasting Trade Act that there is no suitable Canadian ship available to provide the service or perform the activities described in the application.
This determination will be provided to the Minister of Public Safety for any necessary action as provided for in the Coasting Trade Act.
This Decision does not constitute an authority to commence operations in respect of the service for which application has been made.
