COMPLAINT

By letter dated October 14, 1998, Canadian Airlines International Ltd. carrying on business under the firm name and style of either Canadian Airlines International or Canadi*n (hereinafter Canadi*n) filed a complaint with the Canadian Transportation Agency (hereinafter the Agency) respecting fares applicable to KLM Royal Dutch Airlines (hereinafter KLM) for transportation between Moscow and Toronto which undercut the fares of Canadi*n.

By Decision No. LET-A-273-1998 dated October 21, 1998, the Agency provided a copy of the complaint to KLM. The carrier was required to provide its answer to the complaint within three working days from the date of the letter and Canadi*n was advised that it would have one working day from the date of receipt of the answer to reply.

On October 23, 1998, KLM responded to Canadi*n's complaint and advised that the tariffs filed reflected the actual market practices at the time of filing.

On January 20, 1999, Canadi*n provided its reply to KLM's answer and advised the Agency that it was withdrawing its complaint.

CONCLUSION

The Agency notes that Canadi*n has withdrawn its complaint.

The Agency has considered the matter and, pursuant to subsection 37(1) of the National Transportation Agency General Rules, SOR/88-23, hereby accepts Canadi*n's withdrawal of its complaint.
