APPLICATION by Nolisair International Inc. carrying on business as Nationair for a licence to operate a scheduled international service between points in Canada and Venezuela.

Nolisair International Inc. carrying on business as Nationair (hereinafter the applicant) has applied to the National Transportation Agency for a licence to operate the service set out in the title.

By letter dated June 5, 1991, the Minister of Transport, inter alia, advised the National Transportation Agency of his decision to designate the applicant under the Agreement between the Government of Canada and the Government of the Republic of Venezuela on Air Transport signed on June 26, 1990 (hereinafter the Agreement) to operate a scheduled international service between Canada and Venezuela.

The pertinent terms and conditions of the Agreement having been met and the requirements of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) (hereinafter the Act) having been complied with, the Agency, in accordance with the provisions of sections 69 and 88 of the Act, will issue to Nolisair International Inc. carrying on business as Nationair a licence to operate a scheduled international service.

The Agency deems it appropriate in the public interest to include the terms and conditions set out below in the licence to be issued, as they reflect terms of the Agreement and direction of the Minister of Transport.

The licence to be issued pursuant to this Decision shall, in addition to the conditions prescribed by the Air Transportation Regulations, SOR/88-58, be subject to the following terms and conditions:

  1. The Licensee is authorized effective November 1, 1991, to operate a scheduled international service in both directions on the route set out below:

  2. The capacity which may be offered by the Licensee in operating the scheduled international air service authorized herein shall be as follows:
    1. During the period November 1st to April 30th of each year, two flights per week in each direction with B747 or smaller aircraft.
    2. During the period May 1st to October 31st of each year, the residual portion of the Canadian capacity entitlement as specified in the Agreement unused by the other Canadian designated airline and whatever additional capacity can be agreed with the other airlines designated under the Agreement, including Venezuelan designated airlines.
  3. The operation of the scheduled international service authorized herein shall be conducted subject to the provisions of the Agreement and to any applicable arrangements as may be agreed to between Canada and Venezuela.
  4. Unless terminated at an earlier date in accordance with the Act or the Agreement, this licence shall terminate at the termination or expiration of the Agreement, or upon the effective date of any amendments to the Agreement which shall have the effect of eliminating the rights herein authorized.
