APPLICATION by Korean Air Lines Co. Ltd. for authority to operate additional flights between Seoul and Vancouver on December 17 and 24, 2006 and January 6, 2007; and between Seoul and Toronto on December 19 and 22, 2006 and January 2 and 5, 2007.

Korean Air Lines Co. Ltd. (hereinafter Korean Air) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on August 24, 2006 and was amended on September 15, 2006.

Korean Air submits that the additional flights are required to meet the increased demand for travel during the holiday season.

Under Licence No. 975147, Korean Air is authorized to operate a scheduled international service between Korea and Canada in accordance with the Agreement between the Government of Canada and the Government of the Republic of Korea for Air Services signed on September 20, 1989 (hereinafter the Agreement).

Condition No. 1 of Licence No. 975147 states:

The Licensee is authorized to operate the route(s) set out in the Agreement.

The Agreement provides for the operation of four flights with B747, B747 Combi or equivalent aircraft; five flights with MD-11, A340 or equivalent aircraft; or seven flights with L1011, B767 or equivalent aircraft. Combinations of the aircraft types herein shall be permitted, provided that the total capacity operated by the designated airline(s) of each Contracting Party using its own equipment does not exceed a combined total of 1,600 seats per week in each direction.

Under the terms of the Agreement, the aeronautical authorities may approve temporary increases in capacity.

Air Canada filed a letter in support of the application.

The Agency has reviewed and considered the application and the material in support thereof and is satisfied that a temporary increase in the frequency of air services would benefit consumers.

Accordingly, pursuant to section 77 of the Canada Transportation Act, S.C., 1996, c. 10 and as provided for in the Agreement, the Agency hereby authorizes the operation by Korean Air of additional flights between Seoul and Vancouver on December 17 and 24, 2006 and January 6, 2007; and between Seoul and Toronto on December 19 and 22, 2006 and January 2 and 5, 2007.

The authorization granted herein does not exempt Korean Air from the requirements of other legislative acts or regulations, including those of Transport Canada.
