APPLICATION by Fenton Maritime Agencies, on behalf of KWS Partnership, pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence to use the "COLUMBIA CHARLESTON", an American flat-deck barge, to transport project cargo within the Saint John, New Brunswick harbour and to make voyages from other ports in Atlantic Canada to transport project cargo to Saint John, New Brunswick during the period commencing on December 1, 2007 and ending on January 31, 2008.

Fenton Maritime Agencies has, on behalf of KWS Partnership (hereinafter the applicant), applied to the Minister of Public Safety for a licence to operate the service set out in the title. The matter was referred to the Canadian Transportation Agency on November 19, 2007.
The Agency conducted a search of the relevant portion of the marine industry. On November 27, 2007, an objection was filed with the Agency by Nunavut Eastern Arctic Shipping Inc. (hereinafter Nunavut), stating that it had a Canadian flagged barge suitable and available to provide the services described in the application. The applicant filed its reply to the objection on November 30, 2007, and Nunavut withdrew its objection on December 4, 2007.
In light of the foregoing, the Agency has determined pursuant to subsection 8(1) of the Coasting Trade Act that there is no suitable Canadian ship available to provide the service or perform the activities described in the application.
This determination will be provided to the Minister of Public Safety for any necessary action as provided for in the Coasting Trade Act.
This Decision does not constitute an authority to commence operations in respect of the service for which application has been made.
