M5125/N232-2

By Order No. 2006-A-26 dated January 17, 2006, the Canadian Transportation Agency (hereinafter the Agency) exempted New World Aviation, Inc. (hereinafter New World) from the application of section 103.3 of the Air Transportation Regulations, SOR/88-58, as amended in order to permit it to operate its executive type Gulfstream II and IV, V and Challenger 600/601 aircraft for U.S. originating transborder flights for a period of one year from the date of the Order.

Under Licence No. 990113, New World is authorized to operate a non-scheduled international service to transport traffic on a charter basis between points in the United States of America and points in Canada.

On October 24, 2006, New World requested that Order No. 2006-A-26 be amended in order to permit it to also operate Challenger 604 aircraft.

The Agency has considered the matter and finds, pursuant to section 32 of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), that there has been a change in the facts and circumstances pertaining to Order No. 2006-A-26 since it was issued and that this Order should be varied.

Accordingly, the Agency, pursuant to section 32 of the CTA, hereby varies Order No. 2006-A-26 dated January 17, 2006 by permitting New World to also use Challenger 604 aircraft for U.S. originating transborder flights.
