APPLICATION by Air Canada for authority to operate four (4) additional round-trip flights between Vancouver and Seoul on December 29, 30 and 31, 2007 and January 1, 2008 and between Seoul and Vancouver on December 30 and 31, 2007 and January 1 and 2, 2008.

Air Canada has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on December 5, 2007.

Under Licence No. 975048, Air Canada is authorized to operate, inter alia, a scheduled international service, large aircraft, between Canada and Korea in accordance with the Agreement between the Government of Canada and the Government of the Republic of Korea for Air Services signed on September 20, 1989 (hereinafter the Agreement).

Condition No. 1 of Licence No. 975048 states:

The Licensee is authorized to operate the route(s) set out in the Agreement.

The Agreement provides for the operation of four flights with B747, B747 Combi or equivalent aircraft, or five flights with MD-11, A340 or equivalent aircraft, or seven flights with L1011, B767 or equivalent aircraft. Combinations of the aircraft types herein shall be permitted, provided that the total capacity operated by the designated airline(s) of each Contracting Party using its own equipment does not exceed a combined total of 1,600 seats per week in each direction.

Under the terms of the Agreement, the aeronautical authorities may approve temporary increases in capacity agreed between the designated airlines.

Korean Air Lines Co. Ltd. confirmed its agreement to the increased capacity.

The Agency has reviewed and considered the application and the material filed in support thereof and is satisfied that a temporary increase in the frequency of air services would benefit consumers.

Accordingly, pursuant to section 77 of the Canada Transportation Act, S.C., 1996, c. 10, as amended, and as provided for in the Agreement, the Agency hereby authorizes the operation by Air Canada of four (4) additional round-trip flights between Vancouver and Seoul on December 29, 30 and 31, 2007 and January 1, 2008 and between Seoul and Vancouver on December 30 and 31, 2007 and January 1 and 2, 2008.

The authorization granted herein does not exempt Air Canada from the requirements of other legislative acts or regulations, including those of Transport Canada.
