APPLICATION by PF Collins Customs Broker Ltd., on behalf of Husky Oil Operations Ltd., pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence to use the "HEATHER KNUTSEN", a Canadian non duty paid tanker, to transport approximately 130,000 metric tonnes of crude oil for multiple voyages from the White Rose floating production, storage and offloading unit (FPSO) and/or Terra Nova FPSO and/or from Hibernia Platform and/or Whiffen Head, Newfoundland and Labrador to Saint John, New Brunswick and/or Point Tupper and/or Halifax, Nova Scotia and/or Portland, Maine, United States of America via pipeline to Montréal, Quebec, during the period commencing on or about December 30, 2007 and ending on or about June 30, 2008.

PF Collins Customs Broker Ltd. has, on behalf of Husky Oil Operations Ltd., applied to the Minister of Public Safety for a licence to operate the service set out in the title. The matter was referred to the Canadian Transportation Agency on December 11, 2007.
The Canadian Transportation Agency conducted a search of the relevant portion of the marine industry and has determined pursuant to subsection 8(1) of the Coasting Trade Act that there is no suitable Canadian ship available to provide the service or perform the activities described in the application.
This determination will be provided to the Minister of Public Safety for any necessary action as provided for in the Coasting Trade Act.
This Decision does not constitute an authority to commence operations in respect of the service for which application has been made.
