Edmonton Flying Club (hereinafter the applicant) has applied to the National Transportation Agency to operate the service set out in the title. The application was received on August 23, 1989.
Under Licence No. 882894, the applicant is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Group A.
Notice of the application was published on September 5 and 8, 1989 in the newspapers of the area concerned and copies of the notice were sent to selected air carriers and to others believed to be interested. An intervention opposing the granting of the application was filed with the Agency by Aero Aviation Centre (1981) Ltd. (hereinafter Aero Aviation). The applicant replied to the intervention.
The pleadings form part of the public files and may be consulted in the Agency's offices by anyone who so desires. In addition, copies will be provided by the Secretary of the Agency on request.
The Agency has considered the application, the material in support thereof and the intervention referred to.
In its intervention, Aero Aviation indicates that the proposed service would jeopardize the operations of existing carriers and ultimately lead to a decrease in the level of service provided; however, it does not submit evidence to substantiate this claim.
The Agency notes that there is no indication of concern from independent parties such as members of the general public, community representatives or users of air services, that the operation of the proposed service would have any impact on current non-scheduled international services.
In view of the foregoing, the Agency finds it in the public interest to issue a new document of licence to operate a Class 9-4 Charter non-scheduled international service to Edmonton Flying Club and, in accordance with the applicant's indicated intentions, to authorize the Licensee to also use fixed wing aircraft in Group B.
Accordingly, Condition No. 1 of Licence No. 882894 is hereby amended to read:
The Licensee is authorized to use fixed wing aircraft in Groups A and B.
A new document of licence, bearing Licence No. 882894, will be issued to Edmonton Flying Club upon the applicant establishing to the satisfaction of the Agency that it meets the requirements set out in subsection 94(1) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.).
