American Airlines has applied to the Canadian Transportation Agency (hereinafter the Agency) for the approval set out in the title. The application was received on November 21, 2002.
By Decision 626-A-2002 dated November 20, 2002, the Agency approved the use by Swiss International Air Lines Ltd. (hereinafter Swiss) of aircraft and flight crew provided by American Airlines, and the provision by American Airlines of such aircraft and flight crew to Swiss, to permit Swiss to sell transportation in its own name on flights operated by American Airlines between Toronto, Ontario, Canada and Boston, United States and between Calgary, Alberta, Canada and Chicago, United States for a three year period commencing December 1, 2002.
Both American Airlines and its affiliates intend to provide the above aircraft. The code-sharing agreement dated March 22, 2002 between American Airlines and Swiss provides for the use of aircraft from American Airlines and/or its affiliates.
The Agency has reviewed and considered the application and the material filed in support thereof and has found pursuant to section 32 of the Canada Transportation Act (hereinafter the CTA) that there has been a change in the facts or circumstances pertaining to Decision No. 626-A-2002 dated November 20, 2002 since it issued and that this Decision should be varied.
Accordingly, the Agency, pursuant to section 32 of the CTA, hereby varies Decision No. 626-A-2002 by substituting "American Airlines and its affiliates" wherever the name American Airlines appears in the said Decision.
All other conditions set out in Decision No. 626-A-2002 continue to apply.
