This application was filed with the Air Transport Committee of the Canadian Transport Commission. However, the National Transportation Agency is now responsible for the disposition of all matters filed with the Commission.
Beaver Air Services Ltd. (hereinafter the applicant) has applied for the suspension set out in the title. The application was received on October 18, 1987.
Under Licence No. A.T.C. 40/46(C), the applicant is authorized to operate a Class 4 Charter commercial air service using fixed wing aircraft in Groups A, B and C, from a base at The Pas, Manitoba.
It is noted that pursuant to subparagraph 109(2)(d)(ii) of the National Transportation Act, 1987, S.C. 1987, c. 34, Licence No. A.T.C. 40/46(C) is deemed to be a licence pursuant to subsection 72(2) of the National Transportation Act, 1987.
The Agency has reviewed the application and is of the opinion that the application for the proposed suspension should be granted. The application is hereby approved.
The authority to use fixed wing aircraft in Group C under Licence No. A.T.C. 40/46(C) is hereby suspended, pursuant to subsection 75(2) of the National Transportation Act, 1987, until December 31, 1988, or until a licence has been issued by the Agency as an appropriate replacement thereto. Beaver Air Services Ltd. is required to satisfy the Agency, on or before September 30, 1988, that it has the qualifications, as set out in Part II of the National Transportation Act, 1987, necessary for issuance of a licence that is an appropriate replacement for its previously held licence.
This Decision shall form part of Licence No. A.T.C. 40/46(C) and shall remain affixed thereto as long as the said Decision is in force.
