IN THE MATTER OF Decision No. 166-AT-A-2003 dated March 26, 2003 - Richard Fortier vs Air Canada.

In its Decision No. 166-AT-A-2003 dated March 26, 2003 (hereinafter the Decision), the Canadian Transportation Agency (hereinafter the Agency) made a determination with respect to an application filed by Carole Benoit, on behalf of husband, Richard Fortier, concerning difficulties he encountered as a result of, among other things, the non-provision of the assistance he had requested in advance of travel to proceed to the aircraft door for his return flight to Montréal at the Miami airport on January 28, 2001.
The Agency found that the non-provision of the assistance requested by Mr. Fortier to proceed to the aircraft door for his January 28, 2001 return flight to Montréal constituted an undue obstacle to his mobility. As such, the Agency directed Air Canada to take corrective measures and indicated that following its review of the required documents, it would determine whether further action is necessary. The required corrective measures are as follows:
- Submit a report to the Agency on exceptional measures or other specific measures that would be taken to avoid incidents similar to those experienced by Mr. Fortier at the Miami airport. This report should detail the measures taken by Air Canada to ensure the provision of wheelchair assistance in situations where it deals with a subcontractor.
- Issue an information bulletin to its employees at the Miami airport, as well as to the employees of its subcontractor at this same airport, reminding them of the importance of providing services requested by persons with disabilities, in light of the incidents experienced by Mr. Fortier; and provide the Agency with a copy of this bulletin.
On January 27, 2006, Air Canada filed its response to the Decision.
Conclusion
The Agency has considered the measures taken in response to the Decision and is satisfied that Air Canada has met the requirements of the Decision. As such, no further action is necessary in this matter.
