APPLICATION by Connect Air Ltd. carrying on business as Connect Air pursuant to section 61 of the Canada Transportation Act, S.C., 1996, c. 10, as amended, for a licence to operate a domestic service, small aircraft.

Connect Air Ltd. carrying on business as Connect Air (applicant) has applied to the Canadian Transportation Agency (Agency) for a licence to operate the service set out in the title.

To meet the requirement to hold a valid Canadian aviation document as set out in subparagraph 61(a)(ii) of the Canada Transportation Act (CTA), the applicant submitted a document issued to it by the Minister of Transport dated February 5, 2010 which refers to the Aircraft Charter Agreement dated December 2, 2009, and amended on January 21, 2010, between the applicant and Transwest Air Limited Partnership, by its General Partners 101008427 Saskatchewan Ltd. and 101004597 Saskatchewan Ltd. carrying on business as Transwest Air (Transwest).

The Agency has carefully examined the document and is satisfied that it is a Canadian aviation document within the meaning of the CTA.

The applicant filed an affidavit attesting that within the twelve months preceding the filing of the application it did not contravene section 59 of the CTA in that it has not sold, caused to be sold or publicly offered for sale in Canada transportation in respect of the applied for air service without holding the required licence. The applicant has also undertaken in respect of the air service applied for that it will not contravene section 59 of the CTA prior to the issuance of the applied for licence. The Agency is not aware of any evidence that the applicant contravened section 59 of the CTA within the preceding twelve months.

The Agency has reviewed the application and is satisfied that the applicant meets the requirements of section 61 of the CTA.

Accordingly, a licence to operate the following service will be issued to Connect Air Ltd. carrying on business as Connect Air.

Further, to ensure continued compliance with subparagraph 61(a)(ii) of the CTA, the Agency will issue an order pursuant to sections 25 and 28 of the CTA, requiring the applicant to provide the Agency with any documentation that has the effect of altering or proposing to alter the agreement between the applicant and Transwest, or would indicate that the applicant has entered into or is proposing to enter into a similar arrangement with a third party. This order shall form part of the licence.
