IN THE MATTER OF the Regulations Respecting the Training of Personnel Employed in Transportation-Related Facilities or Premises or by Carriers, to Assist Persons with Disabilities Travelling within the Transportation Network, pursuant to subsection 27(2) and section 63.1 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.).

The National Transportation Agency (hereinafter the Agency) has determined that the lack of training of personnel working in the transportation network governed by the National Transportation Act, 1987 (hereinafter the NTA, 1987) constitutes an undue obstacle to the mobility of persons with disabilities.

The Regulations Respecting the Training of Personnel Employed in Transportation-Related Facilities or Premises or by Carriers, to Assist Persons with Disabilities Travelling within the Transportation Network (hereinafter the Regulations) require most Canadian carriers and owners, operators and lessees of passenger terminals in the air, rail and marine passenger transportation network governed by the NTA, 1987 to ensure that their personnel and contractors are trained to proficiency in specific content areas. The level of training is to be consistent with a carrier's or terminal operator's type of operation and appropriate to the requirements of their employees' or contractors' function.

Pursuant to subsection 27(2) of the NTA, 1987, any regulation, order or rule made by the Agency is subject to approval by the Governor in Council.

Pursuant to section 63.1 of the NTA, 1987, the Agency may, with the approval of the Governor in Council, make regulations for the purpose of eliminating undue obstacles in the transportation network governed by the NTA, 1987 to the mobility of persons with disabilities.

The Agency published the Regulations in Part I of the Canada Gazette on March 21, 1992 and distributed its regulatory proposal to approximately 1,300 interested persons for comments.

The Agency has reviewed the submissions filed as a result of that publication and distribution. No major changes to the proposal published in Part I of the Canada Gazette were made.

The Agency has considered the matter and finds it appropriate to make the Regulations as set out in the attached schedule.

Subject to the approval of the Governor in Council as required by subsection 27(2) and section 63.1 of the NTA, 1987, the Regulations as set out in the attached schedule will come into effect on the first anniversary of the date of their publication in Part II of the Canada Gazette.
