APPLICATION by Air Canada to amend Licence No. 975025 by adding the authority to operate a scheduled international service between Canada-Honolulu-Australasia and beyond.

Air Canada has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on October 23, 2000.

Under Licence No. 975025, Air Canada is authorized to operate a scheduled international service, medium aircraft, and a scheduled international service, large aircraft, in accordance with the Air Transport Agreement between the Government of Canada and the Government of the United States of America signed on February 24, 1995 (hereinafter the Agreement).

Condition No. 1 of Licence No. 975025 states:

The Licensee is authorized to operate a scheduled international service between points in Canada and points in the United States of America.

By letter dated September 17, 2000, the Minister of Transport has designated Air Canada to exercise fifth freedom rights beyond Honolulu in accordance with the Agreement.

The Agency has considered the matter and, pursuant to subsection 71(1) of the Canada Transportation Act, S.C. 1996, c. 10 (hereinafter the CTA), deems it to be consistent with the Agreement to amend Condition No. 1 of Licence No. 975025.

Accordingly, the Agency, pursuant to subsection 71(1) of the CTA, hereby amends Condition No. 1 of Licence No. 975025 to read as follows:

The Licensee is authorized to operate a scheduled international service between points in Canada and points in the United States of America, including Canada-Honolulu-Australasia and beyond in accordance with the provisions of Annex 1, Section 3 of the Agreement.

A new document of licence, bearing Licence No. 975025, will be issued.
