APPLICATION by OSG Overseas Ship Management (Canada) Inc., pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence.

APPLICATION

OSG Overseas Ship Management (Canada) Inc. applied for a licence to use the "OVERSEAS SHIRLEY", a Canadian non duty paid tanker, to transport crude oil from the Newfoundland Transhipment Ltd. terminal at Whiffen Head, Newfoundland and Labrador to Portland, Maine, United States of America via pipeline to other eastern Canadian refineries. The ship may also be used to transport crude oil from Whiffen Head or the Statia terminal at Point Tupper, Nova Scotia directly to eastern Canadian terminals and refineries capable of receiving crude oil, commencing on March 20 and ending on April 18, 2010.

FACTS AND DETERMINATION

Canadian Transportation Agency (Agency) staff gave notice of the application to the Canadian marine industry and no Canadian ships were offered. Therefore, the Agency determines that there is no suitable Canadian ship available to perform the activity.

The Agency is providing this determination to the Minister of Public Safety and Emergency Preparedness to consider whether to issue the licence. This Decision is not an authority to operate.
