APPLICATION by Pacific Eagle Aviation Ltd. for suspension of Licence Nos. 980173 and 980174.

Pacific Eagle Aviation Ltd. (Licensee) is licensed to operate a domestic service, small aircraft.

The Licensee is also licensed to operate a non-scheduled international service, small aircraft, to transport traffic on a charter basis between Canada and any other country.

The Licensee has applied for a suspension of licences pursuant to paragraphs 63(2)(b) and 75(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA).

However, as the Licensee does not hold a valid Canadian aviation document, the Canadian Transportation Agency (Agency) has determined that this application should be dealt with pursuant to subsection 63(1) and paragraph 75(1)(a) of the CTA which require the Agency to suspend licences when licensees fail to meet the requirement of subparagraphs 61(a)(ii) and 73(1)(a)(ii) of the CTA.

As the Licensee ceases to meet this requirement, the Agency, pursuant to subsection 63(1) and paragraph 75(1)(a) of the CTA, suspends the licences.

To reinstate the licences, the Licensee is provided with one year to file an application. If, at that time, the Agency concludes that the Licensee meets all the applicable requirements of the CTA, the Agency will reinstate the licences.

If within one year the application for reinstatement is not filed or the Licensee does not meet any of the applicable requirements of the CTA, the Licensee is provided with an additional 30 days following the expiry of one year to show cause why the licences should not be cancelled.
