Determination No. W-2022-55
APPLICATION by Atlantic Towing Limited, pursuant to the Coasting Trade Act, SC 1992, c 31 (Act), for a licence.
Atlantic Towing Limited applied, through its representative, to the Minister of Public Safety and Emergency Preparedness (Minister), for a licence to use the "SEACOR ANDES", an offshore supply ship registered in the Marshall Islands, to transport, in two trips per week, cargo and supplies; facilitate personnel transfer; and support remotely piloted underwater vehicle services and other support operations in support of a mobile offshore drilling unit located 440 km east of St. John's to various installations offshore of Newfoundland. The activity will start on June 15, 2022, and will end on October 15, 2022.
To support the licensing process, the Canadian Transportation Agency (Agency) must determine under section 8 of the Act whether a suitable Canadian ship is available to provide the service.
On April 20, 2022, Agency staff issued to the Canadian marine industry a Notice of Coasting Trade Licence Application (Notice). As per the Notice, operators of Canadian registered ships who intended to file with the Agency an objection to the application or an offer of a ship to perform the activity described in the application were required to do so by May 2, 2022.
On May 2, 2022, Horizon Maritime filed an objection with the Agency and offered two Canadian-registered ships to perform the activity described in the application.
On May 6, 2022, Horizon Maritime informed the Agency that it was withdrawing its objection to the application. No other Canadian ships were offered.
Therefore, the Agency determines that there is no suitable Canadian ship available to perform the activity.
The Minister considers the Agency's Determination in deciding whether to issue the licence. This Determination is not an authority to operate.
