IN THE MATTER OF Licence No. 160059 issued to Cargojet Airways Ltd. carrying on business as Cargojet Regional (Licensee), pursuant to section 32 of the Canada Transportation Act, SC 1996, c 10 (CTA), to operate a scheduled international service, all-cargo aircraft, between points in Canada and points in the Overseas Territories of the United Kingdom.

By Decision No. 284-A-2016 dated September 20, 2016, the Canadian Transportation Agency (Agency) issued a licence to the Licensee authorizing it to operate a scheduled international service, between Canada and the Overseas Territories of the United Kingdom in accordance with the Agreement between the Government of Canada and the Government of the United Kingdom of Great Britain and Northern Ireland concerning Air Services, initialled ad referendum on April 12, 2006.

On December 31, 2020, the Agreement between the Government of Canada and the Government of the United Kingdom of Great Britain and Northern Ireland concerning Air Services, initialled on November 30, 2018 (Agreement), will come into force.

The terms of the Agreement will include the United Kingdom and its overseas territories.

Section 32 of the CTA states that the Agency may review, rescind or vary any decision or order made by it or may re hear any application before deciding it if, in the opinion of the Agency, since the decision or order or the hearing of the application, there has been a change in the facts or circumstances pertaining to the decision, order or hearing.

The Agency has considered the material in support and finds, pursuant to section 32 of the CTA, that there has been a change in the facts or circumstances pertaining to Decision No. 284-A-2016 since it was issued and that it should be varied.

Consequently, the conditions set out in Decision No. 284-A-2016 are replaced with the following:

  1. The Licensee is authorized to operate a scheduled international service on the route(s) set out in the Agreement.
  2. The scheduled international service is to be conducted in accordance with the Agreement and any applicable arrangements agreed to between Canada and the United Kingdom of Great Britain and Northern Ireland.

Pursuant to paragraph 28(1)(b) of the CTA, the Agency may in any order direct that the order or a portion or provision of it shall come into force on the happening of any contingency, event or condition specified in the order. Consequently, Licence No. 160059 is amended at 18:00, Eastern Standard Time, on December 31, 2020.
