Contravention
(A) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA), a designated enforcement officer has issued this notice of violation believing Swoop Inc. has committed 5 violations of failing to provide, free of charge, alternate travel arrangements to passengers (B6RCVJ), and (VCBBGK), whose flight WO770 was cancelled for reasons within the carrier's control, including for safety, to ensure the passengers completed their itinerary as soon as feasible, in the form of a confirmed reservation on the next available flight that it operated or with a carrier with which it had a commercial agreement and that was traveling on any reasonable air route, from the airport at which the passenger was located to the destination indicated on the passenger’s original ticket, thereby contravening paragraph 17(1)(b) of the Air Passenger Protection Regulations (APPR).
These contraventions occurred on or about December 16, 2022.
(B) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA), a designated enforcement officer has issued this notice of violation believing Swoop Inc. has committed 3 violations of failing to refund within 30 days, the unused portions of a ticket to passengers (N84RTW) and (C3QITS), who chose not to complete their itinerary with the alternate travel arrangements provided in accordance with subsection 17(1)(b) of the Air Passenger Protection Regulations (APPR), which did not accommodate their travel needs, following a flight cancellation WO319 within the carrier's control, including for safety, thereby contravening subsection 18.2(2) of those regulations.
These contraventions occurred on or about December 8, 2022.
(C) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA), a designated enforcement officer has issued this notice of violation believing Swoop Inc. has committed 12 violations of failing to provide, free of charge, alternate travel arrangements to passengers (F2KFXI), (XB6UPA), (D5VBVM), (F579YP), (K5UUFM), and (UD9QHH) whose flights WO201, WO319, WO403, WO609, WO209, and WO812 were cancelled for reasons outside of the carrier's control, in the form of a confirmed reservation on the next available flight that it operated by the carrier or with a carrier with which it had a commercial agreement and that was travelling on a reasonable route, from the airport at which the passengers were located to the destination indicated on the passengers' original tickets, thereby contravening subsection 18(1.1) of the Air Passenger Protection Regulations (APPR).
These contraventions occurred between November 3, 2022 and December 24, 2022.
