APPLICATION by Air Charter West Inc. to lift the suspension of Licence Nos. 940277, 940278 and 940279 imposed by Decision Nos. 658-A-1995 dated September 26, 1995 and 1-A-1996 dated January 2, 1996.

Air Charter West Inc. (hereinafter the Licensee) has applied to the National Transportation Agency to lift the suspension set out in the title. The application was received on February 21, 1996.

Under Licence No. 940277, the Licensee is authorized to operate a domestic service.

Under Licence No. 940278, the Licensee was authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Group B, from a base at Cooking Lake, Alberta.

Under Licence No. 940279, the Licensee was authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Group B.

By Decision No. 658-A-1995 dated September 26, 1995, Licence Nos. 940277, 940278 and 940279 were suspended pursuant to subsections 75(2) and 97(2), as applicable, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) (hereinafter the NTA, 1987).

The Licensee subsequently met the requirements of the Agency in respect of the authority to use fixed wing aircraft in Group A and, accordingly, new documents of licence bearing Licence Nos. 940278 (dated October 11, 1995) and 940279 (dated October 19, 1995) were issued to the Licensee authorizing it to also use fixed wing aircraft in Group A.

By Decision No. 1-A-1996 dated January 2, 1996, Licence Nos. 940278 and 940279 in respect of the authority to use fixed wing aircraft in Group A were suspended pursuant to subsections 75(2) and 97(2), respectively, of the NTA, 1987.

The Agency has reviewed the application and is satisfied that the Licensee has the qualifications necessary for the issuance of Licence No. 940277 in its entirety and Licence Nos. 940278 and 940279 in respect of the authority to use fixed wing aircraft in Group A only. Accordingly, the Agency is of the opinion that the suspension of these authorities imposed by Decision Nos. 658-A-1995 and 1-A-1996 should be lifted.

The suspension of Licence No. 940277 in its entirety and Licence Nos. 940278 and 940279 in respect of the authority to use fixed wing aircraft in Group A imposed by Decision Nos. 658-A-1995 dated September 26, 1995 and 1-A-1996 dated January 2, 1996 is hereby lifted.

Licence Nos. 940278 and 940279 in respect of the authority to use fixed wing aircraft in Group B remain suspended as set out in Decision No. 658-A-1995 dated September 26, 1995.
