APPLICATION by Air Canada pursuant to subsection 69(1) of the Canada Transportation Act, S.C., 1996, c. 10, for a licence to operate a scheduled international service, large aircraft, and a scheduled international service, all-cargo aircraft between Canada and Israel.

Air Canada has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on January 19, 2007.

Under Licence No. 060022, Air Canada is authorized to operate a scheduled international service, large aircraft, and a scheduled international service, all-cargo aircraft, in a manner consistent with the Agreed Minute between Canada and Israel signed on March 16, 2006.

Condition No. 3 of Licence No. 060022 states:

This licence, unless cancelled at an earlier date, shall be in effect until March 24, 2007.

By Order No. 2006-A-677 dated December 28, 2006, the Agency, pursuant to paragraph 80(1)(c) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), exempted Air Canada from the application of section 59 of the CTA, thereby permitting the air carrier to sell, cause to be sold or publicly offer for sale in Canada a scheduled international service, large aircraft, and a scheduled international service, all-cargo aircraft, between Canada and Israel, for travel beyond March 24, 2007, subject to certain conditions.

By the Agreed Minute of March 14, 2007, Canada and Israel agreed on arrangements for the operation of scheduled international services for a period of one year until the end of the IATA 2007/2008 winter season.

The Agency has reviewed and considered the application and material in support thereof and is satisfied that Air Canada meets the requirements of paragraph 69(1)(a) of the CTA.

Concerning the duration of the subject authority, the Agency considers it appropriate to grant the authority until March 29, 2008.

Accordingly, pursuant to subsection 78(1) of the CTA, the Agency will issue a new document of licence authorizing Air Canada to operate a scheduled international service, large aircraft, and a scheduled international service, all-cargo aircraft, between Canada and Israel, subject to the following conditions:

  1. The Licensee is authorized to operate a scheduled international service in a manner consistent with the Agreed Minute between Canada and Israel signed on March 14, 2007.
  2. The operation of the scheduled international service authorized herein shall be conducted subject to the provisions of any applicable arrangements as may be agreed to between Canada and Israel.
  3. This licence, unless cancelled at an earlier date, shall be in effect until March 29, 2008.

Any similar requests for a subsequent authority shall be submitted to the Agency for approval by no later than February 26, 2008.

Should the applicant intend to sell, cause to be sold or publicly offer for sale in Canada a scheduled international service for transportation authorized by this licence to be provided beyond the termination date as set out in Condition No. 3 of the licence, it must file an application for and be granted an exemption from section 59 of the CTA by the Agency.
