APPLICATION by Air Canada, on behalf of itself and Swiss International Air Lines Ltd. carrying on business as Swiss (hereinafter Swiss), pursuant to section 32 of the Canada Transportation Act, S.C., 1996, c. 10, to amend the approval granted by Decision No. 645-A-2005 dated October 26, 2005, by adding "its affiliates and subsidiaries" wherever the name Swiss appears in the said Decision.

Air Canada, on behalf of itself and Swiss, has applied to the Canadian Transportation Agency (hereinafter the Agency) for the approval set out in the title. The application was received on February 24, 2006 and was complete and ready for processing on March 20, 2006.

By Decision No. 645-A-2005 dated October 26, 2005, the Agency approved the use by Air Canada and its affiliates of aircraft and flight crew provided by Swiss and the provision by Swiss of aircraft and flight crew to Air Canada and its affiliates, to permit Air Canada to provide its scheduled international service between Canada and Switzerland by selling transportation in its own name on flights operated by Swiss between points in Canada and points in Switzerland, including segments between intermediate points and points in Switzerland, between domestic points in Switzerland and between points in Switzerland and points beyond Switzerland.

Appendix A to the code-sharing agreement between Air Canada and Swiss now provides for the use of aircraft and flight crew belonging to Swiss and its affiliates and subsidiaries.

The Agency has reviewed and considered the application and the material filed in support thereof and has found, pursuant to section 32 of the Canada Transportation Act (hereinafter the CTA), that there has been a change in the facts or circumstances pertaining to Decision No. 645-A-2005 since it issued and that the said Decision should be varied.

Accordingly, the Agency, pursuant to section 32 of the CTA, hereby varies Decision No. 645-A-2005 by including "its affiliates and subsidiaries" wherever the name Swiss appears as the provider of the aircraft and flight crew in the said Decision.

All other conditions set out in Decision No. 645-A-2005 continue to apply.
