IN THE MATTER OF locomotives of the Wisconsin Central Ltd. entering Canada from the United States which are not equipped with a safety control feature (deadman pedal).

WHEREAS after purchasing trackage from Soo Line Railways, Wisconsin Central Ltd. of the United States operate transfer train movements from Sault Ste. Marie, Michigan to CP Rail and Algoma Central Railway yards in Sault Ste. Marie, Ontario.
WHEREAS the track is within yard limits with an approximate speed limit of 10 mph over 2.5 miles of track and the locomotives of Wisconsin Central Ltd. which heretofore have operated entirely in the U.S. do not have a safety control feature (deadman pedal) and therefore are not in compliance with section 30 of the Railway Motive Power Equipment Regulations General Order No. 0-21, C.R.C. 1978, c.1169; and
WHEREAS Wisconsin Central Ltd. is developing an operating plan which will enable it to comply with the said regulation,
WHEREAS Wisconsin Central Ltd. has requested a 60 day period of relief from the requirement to comply with section 30 of the said regulations until the said operating plan is in place,
UPON reading the submission filed,
IT IS ORDERED THAT:
- Wisconsin Central Ltd. is relieved of the requirement of subsections 30(1) and (2) of the Railway Motive Power Equipment Regulations Chapter 1169, for a period of 60 days from the date of this Order.
- While operating a train movement in Canada there shall at all times be a person accompanying the engineman in the locomotive cab who is knowledgeable in stopping the train movement should the engineman become incapacitated.
- Wisconsin Central Ltd. shall file with the National Transportation Agency within 30 days a report which describes its operating plan to achieve full compliance with subsections 30(1) and (2) of the said regulations.
