WHEREAS under Licence No. 883142, Fort Frances Sportsmen Airways Ltd. (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Group B, from a base at Fort Frances (Lake Land Bay), Ontario (restricted);

WHEREAS under Licence No. 883143, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Groups B and C (restricted in respect of the use of Group B aircraft);

WHEREAS by registered letter dated August 21, 1989, the Licensee was required to file a valid certificate of insurance within twenty-one days from the date of the letter;

WHEREAS to date, the Licensee has failed to file with the Agency the required certificate of insurance;

WHEREAS the Agency has determined that the Licensee ceases to have the qualifications necessary for the issuance of the said licences; and

WHEREAS the Agency has reviewed the matter and considers it appropriate to suspend Licence No. 883142 and Licence No. 883143 in respect of the use of aircraft in Group B and to require the Licensee to show cause why Licence No. 883142 and Licence No. 883143 in respect of the use of aircraft in Group B should not be cancelled.

IT IS ORDERED THAT:

1. Licence No. 883142 and Licence No. 883143 in respect of the use of aircraft in Group B are hereby suspended pursuant to paragraph 75(1)(a) and 97(1)(a) respectively, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.).
2. The Licensee is hereby required to show cause within 30 days from the date of this Order why Licence No. 883142 and Licence No. 883143 in respect of the use of aircraft in Group B should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a) of the National Transportation Act, 1987.

This Order shall form part of Licence Nos. 883142 and 883143 and shall remain affixed thereto as long as the said Order is in force.
