WHEREAS under Licence No. 883142, Fort Frances Sportsmen Airways Ltd. (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Group B, from a base at Fort Frances (Lake Land Bay), Ontario (restricted);

AND WHEREAS under Licence No. 883143, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Groups B and C (restricted in respect of the use of Group B aircraft);

AND WHEREAS by Order No. 1989-A-329 dated October 26, 1989, Licence No. 883142 and Licence No. 883143 in respect of the use of fixed wing aircraft in Group B were suspended pursuant to paragraphs 75(1)(a) and 97(1)(a) respectively, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) (hereinafter the NTA, 1987), for failure by the Licensee to file a valid certificate of insurance with the Agency, and the Licensee was required to show cause within 30 days from the date of the Order why the said licences in respect of the use of fixed wing aircraft in Group B should not be cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a) of the NTA, 1987;

AND WHEREAS to date, the Licensee has failed to either file with the Agency the required certificate of insurance or to respond to the show cause Order;

AND WHEREAS the Agency has determined that the Licensee ceases to have the qualifications necessary for the issuance of the said licences in respect of the use of fixed wing aircraft in Group B;

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to cancel Licence No. 883142 and Licence No. 883143 in respect of the use of fixed wing aircraft in Group B.

NOW THEREFORE, IT IS ORDERED THAT:

Licence No. 883142 and Licence No. 883143 in respect of the use of fixed wing aircraft in Group B are hereby cancelled pursuant to paragraphs 75(1)(a) and 97(1)(a) respectively, of the NTA, 1987.

A new document of licence, bearing Licence No. 883143, will be issued.
