IN THE MATTER OF the operation of Class 4 Charter domestic services, a Class 9-4 Charter non-scheduled international service and a domestic service by Contact Airways Ltd. - Licence Nos. 882351, 882352, 882353 and 882354.

WHEREAS under Licence No. 882351, Contact Airways Ltd. (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Groups A, B and C, from a base at Fort McMurray, Alberta;

WHEREAS under Licence No. 882352, the Licensee is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Groups B and C, from a base at Fort Chipewyan, Alberta;

WHEREAS under Licence No. 882353, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Groups B and C;

WHEREAS under Licence No. 882354, the Licensee is authorized to operate a domestic service;

AND WHEREAS by registered letter dated August 17, 1991, the Licensee was required to file with the Agency by October 9, 1991, a declaration in the form set out in Schedule II of the Air Transportation Regulations, SOR/88-58, as prescribed by subsections 10(2) and 15(3) of those Regulations;

AND WHEREAS by registered letter dated October 2, 1991, the Licensee was requested to submit with the Agency a certificate of insurance by November 1, 1991;

AND WHEREAS to date, the Licensee has failed to file with the Agency the requested documents;

AND WHEREAS the Agency has reasonable grounds to believe that, in respect of the services for which the licences are issued, the Licensee ceases to have the qualifications necessary for the issuance of the said licences and/or has contravened section 98 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.);

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to suspend Licence Nos. 882351, 882352, 882353 and 882354 and to require the Licensee to show cause why the said licences should not be cancelled.

NOW THEREFORE, IT IS ORDERED THAT:

  1. Licence Nos. 882351, 882352 and 882354 are hereby suspended pursuant to subsection 75(1) of the National Transportation Act, 1987 and Licence No. 882353 is hereby suspended pursuant to subsection 97(1) of the National Transportation Act, 1987.
  2. The Licensee is hereby required to show cause within thirty (30) days from the date of this Order why the said licences should not be cancelled pursuant to subsections 75(1) and 97(1), as applicable, of the National Transportation Act, 1987.

This Order shall form part of Licence Nos. 882351, 882352, 882353 and 882354 and shall remain affixed thereto as long as the said Order is in force.
