IN THE MATTER OF the operation of a Class 4 Charter domestic service, a domestic service and a Class 9-4 Charter non-scheduled international service by Worldways Canada Ltd. - Licence Nos. 882061, 882062 and 882063.

WHEREAS under Licence No. 882061, Worldways Canada Ltd. (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Group G, from a base at Toronto, Ontario;

AND WHEREAS under Licence No. 882062, the Licensee is authorized to operate a domestic service;

AND WHEREAS under Licence No. 882063, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using fixed wing aircraft in Groups G and H;

AND WHEREAS by registered letter dated July 26, 1991, the Licensee was required to file with the Agency by September 3, 1991, a declaration in the form set out in Schedule II of the Air Transportation Regulations, SOR/88-58, as prescribed by subsections 10(2) and 15(3) of those Regulations;

AND WHEREAS by registered letter dated October 2, 1991, the Licensee was requested to submit with the Agency a certificate of insurance by November 1, 1991;

AND WHEREAS by registered letter dated November 4, 1991, the Licensee was required to show cause within twenty-one (21) days from the date of the letter why the said licences should not be suspended or cancelled pursuant to subsections 75(1) and 97(1), as applicable, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.), for failure by the Licensee to hold a valid operating certificate;

AND WHEREAS to date, the Licensee has failed to respond to the aforementioned letters;

AND WHEREAS the Agency has reasonable grounds to believe that, in respect of the services for which the licences are issued, the Licensee ceases to have the qualifications necessary for the issuance of the licences;

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to suspend Licence Nos. 882061, 882062 and 882063 and to require the Licensee to show cause why the said licences should not be cancelled.

NOW THEREFORE, IT IS ORDERED THAT:

  1. Licence Nos. 882061 and 882062 are hereby suspended pursuant to subsection 75(1) of the National Transportation Act, 1987 and Licence No. 882063 is hereby suspended pursuant to subsection 97(1) of the National Transportation Act, 1987.
  2. The Licensee is hereby required to show cause within thirty (30) days from the date of this Order why the said licences should not be cancelled pursuant to subsections 75(1) and 97(1), as applicable, of the National Transportation Act, 1987.

This Order shall form part of Licence Nos. 882061, 882062 and 882063 and shall remain affixed thereto as long as the said Order is in force.
