IN THE MATTER OF an application by the White Pass and Yukon Corporation Limited, on behalf of the British Yukon Railway Company (hereinafter the applicant), pursuant to section 123 and all other relevant sections of the Railway Act, R.S.C., 1985, c. R-3,

a) for approval of Drawing No. 194-6, dated May 14, 1991 (hereinafter the Plan and Book of Reference) showing the relocation of the northern terminus from mileage 110.7 to mileage 110.5, in the City of Whitehorse, in the Territory of Yukon, on file with the National Transportation Agency (hereinafter the Agency).

WHEREAS the Agency has performed an environmental screening of the proposal pursuant to section 10 of the Environmental Assessment and Review Process Guidelines Order, SOR/84-467 (hereinafter the EARP Guidelines Order);

AND WHEREAS the Agency has determined, pursuant to paragraph 12(c) of the EARP Guidelines Order, that the potentially adverse environmental effects that may be caused by the proposal are insignificant;

AND WHEREAS the Agency is satisfied that sufficient public notice, pursuant to subsection 123(6), has been given prior to the submission of an application to the Agency;

AND WHEREAS the Agency has not received any objection to the proposed change in the railway as constructed;

AND WHEREAS the Agency has reviewed the submissions filed.

NOW THEREFORE, IT IS ORDERED THAT:

The Plan and Book of Reference showing the relocation of the northern terminus of the applicant are hereby approved and sanctioned.
