IN THE MATTER OF an application by Canadian Pacific Limited (hereinafter the applicant), pursuant to section 16 of the Railway Safety Act, R.S.C., 1985, c. 32 (4th Supp.), for a determination by the National Transportation Agency (hereinafter the Agency) of the apportionment of the liability to meet the installation costs associated with the addition of gates and constant warning time devices to the existing automatic protective devices at the crossing at grade of Highway 21, at mileage 84.20 Maple Creek Subdivision, in the town of Maple Creek, in the province of Saskatchewan.

WHEREAS the Agency has reviewed the submissions filed and in accordance with the decision appended hereto.
NOW THEREFORE, IT IS ORDERED THAT:
1. All of the installation costs associated with the addition of the constant warning time devices, after application of the federal grant, shall be paid by the applicant.
2. The balance of installation costs, associated with the addition of gates, after application of the federal grant, shall be shared equally by the applicant and the Department of Highways and Transportation of the Province of Saskatchewan.
3. The cost of future maintenance of the gates and constant warning time devices shall be shared equally by the applicant and the Department of Highways and Transportation of the Province of Saskatchewan.
