IN THE MATTER OF the suspension of Licence No. 951632 imposed by Order No. 1996-A-302 dated August 7, 1996 - Syracuse Executive Air Service, Inc.

WHEREAS under NTA Licence No. 951632, Syracuse Executive Air Service, Inc. (hereinafter the Licensee) is authorized to operate a Class 9-4 Charter non-scheduled international service to transport traffic between points in Canada and points in the United States of America;

AND WHEREAS by Order No. 1996-A-302 dated August 7, 1996, NTA Licence No. 951632 was suspended pursuant to paragraph 75(1)(b) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), for failure by the Licensee to file with the Canadian Transportation Agency (hereinafter the Agency) a valid certificate of insurance. The Licensee was required to show cause within thirty days from the date of the Order why NTA Licence No. 951632 should not be cancelled pursuant to paragraph 75(1)(b) of the CTA;

AND WHEREAS the Air Transportation Regulations, SOR/88-58 have been amended to simplify the various classes of air services that may be operated by a non-Canadian air carrier under a non-scheduled international licence. Accordingly, the Class 9-4 Charter non-scheduled international service operated under NTA Licence No. 951632 is now considered to be a non-scheduled international service;

AND WHEREAS the Licensee has filed a valid certificate of insurance. The Agency is satisfied that the Licensee now meets the licence issuance requirements set out in subparagraph 73(1)(a)(iii) of the CTA and finds that the suspension imposed by Order No. 1996-A-302 should be lifted. In addition, the Agency considers it appropriate to issue a replacement licence to Syracuse Executive Air Service, Inc.;

AND WHEREAS to reflect the services authorized by NTA Licence No. 951632, the Agency deems it appropriate to make the replacement licence subject to the condition that traffic between points in Canada and points in the United States of America shall be carried on on a charter basis.

NOW THEREFORE, IT IS ORDERED THAT:

The suspension of NTA Licence No. 951632 imposed by Order No. 1996-A-302 dated August 7, 1996 is hereby lifted.

The Canadian Transportation Agency will issue replacement Licence No. 967056 to Syracuse Executive Air Service, Inc. authorizing it to operate a non-scheduled international service to carry traffic on a charter basis between points in Canada and points in the United States of America.
