IN THE MATTER OF the operation of a domestic service and a non-scheduled international service by Cypress Jetprop Charter Ltd. - Licence Nos. 972234 and 977390.

Under Licence No. 972234, Cypress Jetprop Charter Ltd. (hereinafter the Licensee) is authorized to operate a domestic service, small aircraft and a domestic service, medium aircraft.

Under Licence No. 977390, the Licensee is authorized to operate a non-scheduled international service, small aircraft, and a non-scheduled international service, medium aircraft, to transport traffic on a charter basis between Canada and any other country.

By Order No. 1997-A-725 dated December 8, 1997, Licence Nos. 972234 and 977390 were suspended pursuant to subsection 63(1) and paragraph 75(1)(a) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), for failure by the Licensee to hold a valid operating certificate. The Licensee was required to show cause within thirty (30) days from the date of the Order why Licence Nos. 972234 and 977390 should not be cancelled pursuant to subsection 63(1) and paragraph 75(1)(a) of the CTA.

In response to the Order requiring the Licensee to show cause why Licence Nos. 972234 and 977390 should not be cancelled, the Licensee has advised the Canadian Transportation Agency (hereinafter the Agency) that it has no objection to its licences being cancelled.

Pursuant to paragraphs 63(2)(b) and 75(2)(b) of the CTA, the Agency may suspend or cancel a domestic licence and a non-scheduled international licence in accordance with a request from the Licensee for the suspension or cancellation.

The Agency has considered the matter and pursuant to paragraphs 63(2)(b) and 75(2)(b) of the CTA, hereby cancels Licence Nos. 972234 and 977390.
