IN THE MATTER OF an application by the Council of Canadians with Disabilities for Council of Canadians with Disabilities for pursuant to subsections 27(1) and 28(2) of the Canada Transportation Act, S.C. 1996, c. 10, and for a final order pursuant to section 172 of the Canada Transportation Act with respect to VIA Rail Canada Inc.'s Nightstock cars; and
IN THE MATTER OF Decision No. LET-AT-R-176-2001 dated April 3, 2001 and the requirement for the production of documents as described and explained in that Decision.

By letter dated December 4, 2000, the Council of Canadians with Disabilities (hereinafter CCD) filed an application with the Canadian Transportation Agency (hereinafter the Agency) as set out above.
The Agency requires the production of certain documents, as described and explained in Decision No. LET-AT-R-176-2001, in order to assist it in considering CCD's application.
The Agency hereby orders VIA Rail Canada Inc. to produce the following documents, as soon as they are available, by filing with the Agency and providing a copy to CCD:
- A schedule indicating when the retrofitting or construction of the cars for both the substantially completed cars and the uncompleted cars (shells) will begin; and
- The final design of the Nightstock cars for both the substantially completed cars and the uncompleted cars (shells).
