IN THE MATTER OF the operation of a domestic service and a non-scheduled international service by 593897 Alberta Ltd. carrying on business as B. Allison Flying Services - Licence Nos. 962283 and 010103.

Under Licence No. 962283, 593897 Alberta Ltd. carrying on business as B. Allison Flying Services (the Licensee) is authorized to operate a domestic service, small aircraft.

Under Licence No. 010103, the Licensee is authorized to operate a non-scheduled international service, small aircraft, to transport traffic on a charter basis between Canada and any other country.

By Order No. 2008-A-322 dated August 27, 2008, the Canadian Transportation Agency (the Agency) suspended Licence Nos. 962283 and 010103 as Transport Canada had advised the Agency that the Canadian aviation document of the Licensee has been suspended effective August 22, 2008.

Following the issuance of that Order, the Agency discovered that the Canadian aviation document had, in fact, been surrendered in respect of IFR and Night VFR authorizations only.

Pursuant to section 32 of the Canada Transportation Act, S.C., 1996, c. 10, as amended (the CTA), the Agency may review, rescind or vary an order if, in the opinion of the Agency, since the issuance of the order, there has been a change in the facts or circumstances pertaining to that order.

The Agency has considered the matter and finds that there has been a change in the circumstances since the issuance of that order and that the Order should be rescinded.

Accordingly, the Agency, pursuant to section 32 of the CTA, hereby rescinds Order No. 2008-A-322 dated August 27, 2008.
