IN THE MATTER OF the operation of a scheduled international service by Zoom Airlines Limited - Licence No. 070115.

Under Licence No. 070115, Zoom Airlines Limited (the Licensee) is authorized to operate a scheduled international service on the routes set out in clause 1(B)(1) of Annex I of the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of Canada concerning Air Services initialled ad referendum on April 12, 2006.

By Order No. 2008-A-422 dated October 15, 2008, Licence No. 070115 was suspended pursuant to subsection 72(1) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (the CTA), as the insurance coverage prescribed in the Licensee's certificate of insurance on file with the Canadian Transportation Agency (the Agency) had been cancelled. The Licensee was provided with a period of thirty (30) days from the date of the Order to show cause why Licence No. 070115 should not be cancelled pursuant to subsection 72(1) of the CTA.

To date, the Licensee has failed to either file with the Agency the required certificate of insurance or to show cause why its licence should not be cancelled.

The Agency has determined that, in respect of the service for which the licence was issued, the Licensee does not meet the requirement of subparagraphs 69(1)(a)(iii) of the CTA.

Pursuant to subsection 72(1) of the CTA, the Agency must suspend or cancel a scheduled international licence where the Agency has made such a determination.

The Agency has considered the matter and, pursuant to subsection 72(1) of the CTA, cancels Licence No. 070115.
