CANCELLATION of Midwest Airlines, Inc. carrying on business as Midwest Express Airlines's Licence Nos. 975075 and 977232.

In its Order No. 2010-A-6 dated January 6, 2010, the Canadian Transportation Agency (Agency), pursuant to subsection 72(1) and paragraph 75(1)(b) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA), suspended the scheduled international and non-scheduled international licences of Midwest Airlines, Inc. carrying on business as Midwest Express Airlines (Licensee). The Agency took this action because the Licensee did not have the prescribed liability insurance coverage. The Licensee was provided with 30 days to show cause why its licences should not be cancelled.

To date, the Licensee does not have the prescribed liability insurance coverage and has failed to show cause why its licences should not be cancelled.

The Agency concludes that the Licensee does not meet the applicable requirements of the CTA.

Pursuant to subsection 72(1) and paragraph 75(1)(b) of the CTA, the Agency must cancel the licences.

Accordingly, the Agency, pursuant to subsection 72(1) and paragraph 75(1)(b) of the CTA, cancels the licences.
