APPLICATION by P.A.L. Airlines Ltd. (P.A.L.) for a reduction of the notice period requirement set out in subsection 64(2) of the Canadian Transportation Act, S.C. 1996, c. 10, as amended (CTA).

On March 31, 2016, P.A.L. was informed that the request for a reduction of the notice period for the proposed discontinuance of its domestic service between Wabush, Newfoundland and Labrador and Schefferville, Quebec was granted conditional upon compliance with the terms set out below before April 5, 2016:

1. P.A.L. is required to provide notice in the prescribed form to the following parties of its proposed discontinuance of service and file proof of all notifications with the Agency:

  • the federal Minister of Transport;
  • the minister responsible for transportation in the province of Quebec;
  • elected officials of the municipal or local government of Schefferville; and,
  • the local community of Schefferville, by publishing, in both official languages, a notice in the newspapers with the largest circulation in Schefferville and by posting a notice on the community bulletin board.

2. P.A.L. shall ensure that any passengers already booked on flights beyond the date of discontinuance are provided with a full refund.

The Agency acknowledges that on April 1, 2016, the notice has been posted on the community bulletin board, which is one of the vehicles to communicate local news to residents of Schefferville. The Agency also acknowledges arrangements that P.A.L. has made to publish a notice in the upcoming issue of Journal Trait d’union du Nord newspaper. The Agency accepts these arrangements as actual compliance with the Agency’s condition to publish, in both official languages, a notice in the newspapers with the largest circulation in Schefferville.

This Order takes effect on April 4, 2016, the date on which it was communicated verbally to P.A.L.
