APPLICATION by Air Canada for cancellation of Licence No. 000022 in respect of all-cargo aircraft.

Air Canada has applied to the Canadian Transportation Agency (hereinafter the Agency) for the cancellation set out in the title. The application was received on December 18, 2007.

Under Licence No. 000022, Air Canada is authorized to operate a scheduled international service, medium aircraft, a scheduled international service, large aircraft and a scheduled international service, all-cargo aircraft, on the route(s) set out in the Air Services Agreement between the Government of Canada and the Government of the Russian Federation, signed on December 18, 2000, as amended (hereinafter the Agreement).

Pursuant to paragraph 72(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (hereinafter the CTA), the Agency may suspend or cancel a scheduled international licence in accordance with a request from the Licensee for the suspension or cancellation.

The Agency notes that by Diplomatic Note dated November 19, 2007, the Department of Foreign Affairs and International Trade concludes that the Agreement does not expressly include all-cargo operations and as such, all-cargo operations are not an agreed service under the Agreement.

The Agency has considered the application and, pursuant to paragraph 72(2)(b) of the CTA and consistent with the Diplomatic Note of November 19, 2007 from Canada's Department of Foreign Affairs and International Trade, hereby cancels Licence No. 000022 in respect of all-cargo aircraft.

A new document of licence bearing Licence No. 000022 will be issued to Air Canada.
