Sound Flight, Inc. carrying on business as Tronsdal Air (hereinafter the Licensee) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the reinstatement of Licence No. 967647. The application was received on July 6, 2004 and was complete and ready for processing on January 17, 2005.
Pursuant to subsection 29(1) of the Canada Transportation Act (hereinafter the CTA), the Agency is required to make its decision no later than 120 days after the application is received unless the parties agree to an extension. In this case, the applicant has agreed to an extension of the deadline until March 3, 2005.
Under Licence No. 967647, the Licensee is authorized to operate a non-scheduled international service to transport traffic on a charter basis between points in the United States of America and points in Canada.
By Decision No. 6-A-2004 dated January 5, 2004, Licence No. 967647 was suspended pursuant to paragraph 75(2)(b) of the CTA. Pursuant to that Decision, the Licensee was provided with a period of one year from the date of the Decision to file an application to reinstate the said licence.
The Agency notes that the Licensee has changed its name to Sound Flight, Inc.
The Agency has reviewed the application and is satisfied that the Licensee meets the requirements of subparagraphs 73(1)(a)(ii) and (iii) and paragraph 73(2)(a) of the CTA.
Accordingly, the suspension of Licence No. 967647 imposed by Decision No. 6-A-2004 dated January 5, 2004 is no longer in effect.
In addition, a new document of licence bearing Licence No. 967647 will be issued to Sound Flight, Inc.
