APPLICATION by PF Collins Customs Broker Ltd., on behalf of Irving Oil Limited, pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence to use the "EAGLE BALTIMORE", a tanker registered in Singapore, to carry approximately 98,000 metric tonnes of crude oil per voyage, for two voyages from Whiffen Head, Newfoundland to the Canaport monobuoy in Saint John, New Brunswick and/or Dartmouth and/or Halifax, Nova Scotia and/or Portland, Maine, United States of America via pipeline to Montréal, Quebec, during the period commencing on June 8, 2005 and ending on July 8, 2005. The lifting windows will be on June 9/10 and on June 16/17, 2005.

PF Collins Customs Broker Ltd. has, on behalf of Irving Oil Limited, applied to the Minister of National Revenue for a licence to operate the service set out in the title. The matter was referred to the Canadian Transportation Agency on May 27, 2005.

The Canadian Transportation Agency conducted a search of the relevant portion of the marine industry and has determined pursuant to subsection 8(1) of the Coasting Trade Act that there is no suitable Canadian ship available to provide the service or perform the activities described in the application.

This determination will be provided to the Minister of National Revenue for any necessary action as provided for in the Coasting Trade Act.

This Decision does not constitute an authority to commence operations in respect of the service for which application has been made.
