APPLICATIONS by Transaero Airlines for authority to operate scheduled international services between Moscow, Russian Federation and, in combination, Montréal, Quebec, Canada and Toronto, Ontario, Canada and to also operate scheduled international services on the route Saint Petersburg, Russian Federation - Toronto, Ontario, Canada - Saint Petersburg under Licence No. 040108.

Transaero Airlines has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authorities set out in the title. Transaero Airlines would like authority to operate scheduled international services on the routes: Moscow-Montréal-Toronto-Montréal-Moscow; Moscow-Toronto-Montréal-Toronto-Moscow; and Saint Petersburg-Toronto-Saint Petersburg. The applications were received on November 16 and December 5, 2006.

Under Licence No. 040108, Transaero Airlines is authorized to operate a scheduled international service subject to the provisions of the Air Services Agreement between the Government of Canada and the Government of the Russian Federation signed on December 18, 2000, as amended (hereinafter the Agreement).

Condition No. 1 of Licence No. 040108 states:

The Licensee is authorized to operate scheduled international services in each direction on the routes Moscow-Montréal and Moscow-Toronto.

With respect to Transaero's request to combine services to Montréal and Toronto, the Agency notes that the Agreement permits service to points in Canada on the same flight or separately, provided that no local traffic is carried between the Canadian points.

By Diplomatic Note dated June 2, 2006, Transaero Airlines has also been designated by the Ministry of Foreign Affairs of the Russian Federation pursuant to the Agreement to perform scheduled carriage of passengers, baggage, cargo and mail on the route of Saint Petersburg-Toronto-Saint Petersburg.

The Agency has considered the matter and, pursuant to subsection 71(1) of the Canada Transportation Act, S.C. 1996, c. 10 (hereinafter the CTA), deems it to be consistent with the Agreement to amend Condition No. 1 of Licence No. 040108 as set out below.

Accordingly, the Agency, pursuant to subsection 71(1) of the CTA, hereby amends Condition No. 1 of Licence No. 040180 to read as follows:

The Licensee is authorized to operate agreed services on the routes:

Moscow-Montréal-Moscow; Moscow-Toronto-Moscow; Moscow-Montréal-Toronto-Montréal-Moscow; Moscow-Toronto-Montréal-Toronto-Moscow; and Saint Petersburg-Toronto-Saint Petersburg.

A new document of licence bearing Licence No. 040108 will be issued.
