APPLICATION by Aerovias del Continente Americano S.A. carrying on business as Avianca pursuant to subsection 78(2) of the Canada Transportation Act, S.C., 1996, c. 10, as amended.

Aerovias del Continente Americano S.A. carrying on business as Avianca (Avianca) has applied to the Canadian Transportation Agency (Agency) for a temporary licence to operate an international air service on a scheduled basis, limited to four flights per week, between Canada and Colombia.

Under temporary Licence No. 050007, Avianca is authorized to operate an international air service on a scheduled basis, limited to five flights per week, between Canada and Colombia.

Condition No. 2 of the licence states:

This licence shall terminate on October 31, 2010.

Avianca states that it is going to continue to be the participating designated airline of Colombia. Also, Avianca submits that it will continue with the code-share arrangement with Air Canada which commenced in January 2005.

The authority requested by Avianca is extra-bilateral because there is no agreement or arrangement between Canada and Colombia which provides for the operation by an air carrier of a scheduled international air service between Canada and Colombia.

Prior to operating an international air service, Avianca must, in addition to holding a licence, hold a valid Canadian aviation document and have the prescribed liability insurance coverage. The Agency has considered the material on file and is satisfied that Avianca meets those requirements.

Concerning the duration of the subject authority, the Agency considers it appropriate to grant the authority until October 31, 2011.

Accordingly, pursuant to subsection 78(2) of the Canada Transportation Act, the Agency amends Condition Nos. 1 and 2 of temporary Licence No. 050007 to read:

  1. The Licensee is authorized to operate an international air service on a scheduled basis, limited to four flights per week, between Canada and Colombia.
  2. This licence shall terminate on October 31, 2011.

Any similar requests for a subsequent authority shall be submitted to the Agency for approval one month prior to the expiry of the licence.
