IN THE MATTER OF a complaint by Air Canada against tariffs filed by Northwest Airlines, Inc. and KLM Royal Dutch Airlines.

BACKGROUND

By letter dated October 14, 1998, Air Canada filed a complaint with the Canadian Transportation Agency (hereinafter the Agency) respecting fares applicable to Northwest Airlines, Inc. and KLM Royal Dutch Airlines for transportation between Bern, Switzerland and Canada which undercut the fares of Air Canada.

On October 16, 1998, the Agency provided a copy of the complaint to Northwest Airlines, Inc. and KLM Royal Dutch Airlines. The carriers were required to provide their answer to the complaint within three working days from the date of the letter and Air Canada was advised that it would have one working day from the date of receipt of the answer to reply. The Agency also suspended the applicable fares pending determination of the matter.

In response to Air Canada's complaint, Northwest Airlines, Inc. and KLM Royal Dutch Airlines have withdrawn the said fares.

CONCLUSION

The Agency notes that Northwest Airlines, Inc. and KLM Royal Dutch Airlines have withdrawn the applicable fares which were the basis of Air Canada's complaint.

Following its consideration of the matter, the Agency concludes that as a result of the corrective measures taken by Northwest Airlines, Inc. and KLM Royal Dutch Airlines, no further action is required.
