APPLICATION by El Al Israel Airlines Ltd. pursuant to subsection 69(1) of the Canada Transportation Act, S.C., 1996, c. 10, as amended.

El Al Israel Airlines Ltd. (El Al) has applied to the Canadian Transportation Agency (Agency) for a licence to operate a scheduled international service between Israel and Canada.

El Al is licensed to operate a scheduled international service in a manner consistent with the Agreed Minute between Israel and Canada signed on February 22, 2010.

Condition No. 3 of the licence states:

This licence shall terminate on March 26, 2011.

By Order No. 2011-A-55, the Agency, pursuant to paragraph 80(1)(c) of the Canada Transportation Act (CTA), exempted El Al from the application of section 59 of the CTA, permitting it to sell, cause to be sold or publicly offer for sale in Canada a scheduled international service between Israel and Canada for travel beyond March 26, 2011, without holding the required licence, subject to certain conditions.

By the Agreed Minute, signed on February 4, 2011, Israel and Canada agreed on arrangements for the operation of scheduled international services for a period of one year until the end of the IATA 2011‑2012 winter season.

The Agency is satisfied that El Al meets all the applicable requirements of paragraph 69(1)(a) of the CTA.

Concerning the duration of the subject authority, the Agency considers it appropriate to grant the authority until March 25, 2012.

Accordingly, the Agency approves the application for a licence to operate a scheduled international service between Israel and Canada.

Pursuant to subsection 71(1) of the CTA, the licence is subject to the conditions prescribed by the Air Transportation Regulations, SOR/88-58, as amended, and the following conditions:

  1. The Licensee is authorized to operate a scheduled international service in a manner consistent with the Agreed Minute between Israel and Canada signed on February 4, 2011.
  2. The scheduled international service is to be conducted in accordance with any applicable arrangements agreed to between Israel and Canada.
  3. This licence shall terminate on March 25, 2012.

Any similar request for a subsequent authority shall be submitted to the Agency for approval one month prior to the expiry of the licence.
