APPLICATION by Korean Air Lines Co. Ltd., pursuant to section 32 of the Canada Transportation Act, S.C., 1996, c. 10, as amended, to amend the authority granted by Decision No. 521-A-2007 dated October 22, 2007, in order to permit Korean Air Lines Co. Ltd. to operate four (4) additional flights between Seoul and Vancouver on December 16, 23 and 30, 2007 and January 6, 2008; and to operate four (4) additional flights between Seoul and Toronto on December 18 and 22, 2007 and January 5 and 8, 2008.

Korean Air Lines Co. Ltd. (hereinafter Korean Air) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the amendment set out in the title. The application was received on November 1, 2007.

By Decision No. 521-A-2007 dated October 22, 2007, the Agency permitted Korean Air to provide capacity, by using a combination of B747 and B777 aircraft in the operation of its scheduled international service between Korea and Canada, for a total of 2,049 seats per week in each direction, from October 28, 2007 to March 30, 2008.

Under Licence No. 975147, Korean Air is authorized to operate a scheduled international service between Korea and Canada in accordance with the Agreement between the Government of Canada and the Government of the Republic of Korea for Air Services, signed on September 20, 1989 (hereinafter the Agreement).

The Agreement provides that the total capacity to be operated during the IATA winter season by the designated airline(s) of each Contracting Party using its own equipment shall not exceed a combined total of 1,600 seats per week in each direction.

Korean Air submits that the additional capacity is required in order to meet increased consumer demand during the winter holiday season.

The Agency has reviewed and considered the application and the material filed in support thereof and finds, pursuant to section 32 of the Canada Transportation Act (hereinafter the CTA), that there has been a change in the facts or circumstances pertaining to Decision No. 521-A-2007 since it issued and that this Decision should be varied.

Under the terms of the Agreement, the aeronautical authorities may approve temporary increases in capacity agreed between the designated airlines.

Air Canada confirmed its agreement to the increased capacity.

Accordingly, the Agency, pursuant to section 32 of the CTA, hereby varies Decision No. 521-A-2007 dated October 22, 2007 by permitting Korean Air to operate four (4) additional flights between Seoul and Vancouver on December 16, 23 and 30, 2007 and January 6, 2008; and to operate four (4) additional flights between Seoul and Toronto on December 18 and 22, 2007 and January 5 and 8, 2008.

All other conditions set out in Decision No. 521-A-2007 continue to apply.
