By Order No. 2006-A-497 dated September 28, 2006, the Canadian Transportation Agency (hereinafter the Agency) exempted New World Jet Corporation (hereinafter New World Jet) from the application of section 103.3 of the Air Transportation Regulations, SOR/88-58, as amended in order to permit it to operate its executive type CL604, Falcon 2000, Gulfstream III, Gulfstream IV, Gulfstream V, CL600-601, Falcon 900 and Falcon 50 aircraft for U.S. originating transborder flights for a period of one year from the date of the Order.
Under Licence No. 961079, New World Jet is authorized to operate a non-scheduled international service to transport traffic on a charter basis between points in the United States of America and points in Canada.
On January 24, 2007, New World Jet requested that Order No. 2006-A-497 be amended in order to permit it to also operate Bombardier BD700 aircraft.
The Agency has considered the matter and finds, pursuant to section 32 of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), that there has been a change in the facts and circumstances pertaining to Order No. 2006-A-497 since it was issued and that this Order should be varied.
Accordingly, the Agency, pursuant to section 32 of the CTA, hereby varies Order No. 2006-A-497 dated September 28, 2006 by permitting New World Jet to also use Bombardier BD700 aircraft for U.S. originating transborder flights.
