APPLICATION by El Al Israel Airlines Ltd. pursuant to subsection 69(1) of the Canada Transportation Act, S.C., 1996, c. 10, as amended, for a licence to operate a scheduled international service between Israel and Canada.

El Al Israel Airlines Ltd. (El Al) has applied to the Canadian Transportation Agency (Agency) for the authority set out in the title. The application was complete on February 18, 2009.

Under Licence No. 080016, El Al is authorized to operate a scheduled international service in a manner consistent with the Agreed Minute between Canada and Israel signed on February 27, 2008.

Condition No. 3 of Licence No. 080016 states:

This licence, unless cancelled at an earlier date, shall be in effect until March 29, 2009.

By Order No. 2009-A-65 dated February 12, 2009, the Agency, pursuant to paragraph 80(1)(c) of the Canada Transportation Act (CTA) exempted El Al from the application of section 59 of the CTA, thereby permitting the air carrier to sell, cause to be sold or publicly offer for sale in Canada a scheduled international service between Israel and Canada for travel beyond March 29, 2009, subject to certain conditions.

By the Agreed Minute of February 17, 2009, Canada and Israel agreed on arrangements for the operation of scheduled international services for a period of one year until the end of the IATA 2009/2010 winter season.

The Agency finds that El Al meets the requirements of paragraph 69(1)(a) of the CTA.

Concerning the duration of the subject authority, the Agency considers it appropriate to grant the authority until March 27, 2010.

Accordingly, pursuant to subsection 78(1) of the CTA, the Agency will issue a new document of licence authorizing the Licensee to operate a scheduled international service, subject to the following conditions:

  1. The Licensee is authorized to operate a scheduled international service in a manner consistent with the Agreed Minute between Canada and Israel signed on February 17, 2009.
  2. The operation of the scheduled international service authorized herein shall be conducted subject to the provisions of any applicable arrangements as may be agreed to between Canada and Israel.
  3. This licence, unless cancelled at an earlier date, shall be in effect until March 27, 2010.

Any similar request for a subsequent authority shall be submitted to the Agency for approval by no later than February 26, 2010.

Should the applicant intend to sell, cause to be sold or publicly offer for sale in Canada a scheduled international service for transportation authorized by this licence to be provided beyond the termination date as set out in Condition No. 3 of the licence, it must file an application for and be granted an exemption from section 59 of the CTA by the Agency.
