APPLICATION by Air Holland Charter B.V. to reinstate Licence No. 970115.

Air Holland Charter B.V. (hereinafter the Licensee) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the reinstatement of Licence No. 970115. The application was received on September 11, 2003.

Under Licence No. 970115, the Licensee is authorized to operate a non-scheduled international service to transport traffic on a charter basis between points the Netherlands and points in Canada.

By Decision No. 496-A-2003 dated August 29, 2003, Licence No. 970115 was suspended pursuant to paragraph 75(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA). Pursuant to that Decision, the Licensee was provided with a period of one year from the date of the Decision to file an application to reinstate the said licence.

On September 11, 2003, the Licensee filed an application to reinstate the said licence.

On May 6, 2004, the Licensee advised the Agency that it had ceased operations and went into bankruptcy in February 2004.

To date, the Licensee has failed to demonstrate to the satisfaction of the Agency that it meets the requirement of subparagraph 73(1)(a)(iii) of the CTA, Accordingly, the application is hereby denied.

In addition, as the Licensee does not meet the requirement of subparagraph 73(1)(a)(iii) of the CTA, Licence No. 970115 is hereby cancelled pursuant to paragraph 75(1)(b) of the CTA.

Further, the Agency will not process the Licencee's application for a change of name as this matter is now moot.
